The company terms and conditions of ‘Aquashak’ will not affect your statutory rights in any way.

Every order made to ‘Aquashak’ for the purchase of goods will be subject to these terms and conditions.

The goods advertised by ‘Aquashak’ are subject to availability. If for some reason we have not supplied the goods which have been ordered, your credit card / debit card will be refunded as soon as possible for the full amount of the unsupplied good(s).

‘Aquashak’ will not be held responsible for any compensation to you for any other losses or expenses which you may have suffered as a result of the goods not being supplied. 

‘Aquashak’ will not be held responsible for any losses, damages or expenses which are a result of unspecified or incorrect use or fitting of products supplied by us. If you are uncertain of the correct application or specified usage of any fittings, products or user instructions that are supplied with the products then please do not hesitate to contact us.

Note: Various products which are supplied by ‘Aquashak’ are subject to the Highway Code.  ‘Aquashak’ will not be held responsible for any fines, prosecutions, convictions or penalty points, which are a result of the use of these goods.  Always seek the advice of your local law enforcement before use.

‘Aquashak’ aim to deliver all goods within the time scale stated.  However goods are subject to availability and sometimes a delay in delivery of goods is beyond our control.  The dates which we specify for the delivery of goods are approximations only and we shall not be deemed liable for any damages, expenses, losses, charges or costs resulting from any delay in the delivery of the goods.

If for some reason delivery be delayed by more than 28 days, you will then have the right to contact us and refuse to accept the goods which you have ordered.

Prices

Prices advertised on this website are in UK Pounds Sterling and include VAT @ 17.5% except for books and children’s clothing which are zero rated.  For any orders which are placed from outside the EEC the purchaser will be responsible for the payment of import duties relevant to their country of resident, and the VAT exempt icon should be checked. The cost of delivery is not included in the shopping cart total.  The cost of delivery is calculated at the checkout stage and is based on the size and destination of the order.


Stock Levels

Products are subject to availability. If for some cause ‘Aquashak’ is unable to supply any part of an order, we will contact you by telephone or email and advise you. It might be necessary to refund or cancel that item from your order. Funds which have been debited in respect to any out of stock item will be refunded as soon as possible to the source of payment.


Faulty Products

If you consider a product of ‘Aquashak’ is defective from the point of sale you have three weeks to decline the product. This item must be in an unused condition and have evidence that the product has a manufacturing fault that existed from the point of sale. It is the decision of ‘Aquashak’ as to how we deal with the fault, whether we make a reduction from an identical product or carry out an in-house repair, customers will be informed by telephone or email as to our decision.


Product Guarantee’s

All products sold by ‘Aquashak’ come with their normal manufacturer’s warranty.


Delivery

It is the policy of ‘Aquashak’ to process all orders as quickly as possible. Orders will be processed as soon as they are received and shipped as soon as possible, so our clients receive a fast and efficient service.  However, ‘Aquashak’ regret that sometimes for reasons beyond our control, this is not always possible.  Such as during busy periods, orders may not be processed until the next working day.

Delays

‘Aquashak’ will not consider ourselves liable for any delays unless we believe the delay occurs as a result of our disregard.  The duration for completion and shipment of our orders is taken in good trust, but is not assured.  However ‘Aquashak’ do make all efforts to make shipping times as punctual as possible.


Product Descriptions

‘Aquashak’ endeavour to be as accurate as possible in our description of advertised products.  However, ‘Aquashak’ do not guarantee that product description is completely free from error, in-date, reliable or complete. If a product purchased from ‘Aquashak’ is not as described, your only solution is to return the item it in unused condition.


Recycling Policy

In order to reduce our carbon foot print and try make less of an impact on the worlds natural resources, ‘Aquashak’ reuse all suitable boxes and packaging for the shipment of all our customers orders.


Sub-contracting

‘Aquashak’ may from time to time sub-contract all or part of the any work contracted to us by the customer.  Sub-contractors which are used will be subject to all the rights and benefits contained in these Terms and Conditions. In the event in which a sub-contractor is used ‘Aquashak’ still remain responsible to the customer for the efficiency of this sub-contractor.


Under 18’s

Under 18’s wishing to purchase products from this website must do so with the accompaniment of an adult.  ‘Aquashak’ do not sell products directly to children. We sell children’s products for purchase by adults, parents or guardians.
